Terms of Service

1. Purpose

These Terms of Service (hereinafter the "Terms") govern the conditions under which SXN Labs provides its services, websites and applications (hereinafter the "Services") and the conditions under which users (hereinafter the "User") access and use them.

Using the Services implies full and unreserved acceptance of these Terms.

3. Hosting

The Services are hosted by cloud infrastructure providers located within the European Union. The hosting provider's details can be obtained on request at nathan@sxnlabs.com.

4. Description of the Services

SXN Labs offers consulting, design, development and maintenance services for business software, as well as tools and applications dedicated to its clients and users.

SXN Labs reserves the right to update, modify or suspend all or part of the Services at any time and without prior notice.

5. Access to the Services

The Services are available 24 hours a day, 7 days a week, subject to possible maintenance, updates or events of force majeure.

Some features may require the creation of an account or authentication through a third-party provider (e.g. Google). The User is responsible for the confidentiality of their credentials and for all actions performed via their account.

6. User obligations

The User agrees to:

• Use the Services in accordance with their intended purpose and in good faith.
• Not undermine the security, integrity or availability of the Services.
• Not attempt to access areas, data or accounts they are not authorized to use.
• Not use the Services for unlawful, fraudulent, defamatory or improper purposes.
• Not distribute, through the Services, content that is illegal, protected by third-party rights, or harmful to others.
• Comply with applicable laws and regulations, in particular regarding data protection and intellectual property.

7. Intellectual property

All elements composing the Services (texts, source code, graphics, logos, images, videos, trademarks, databases, etc.) are protected by applicable intellectual property laws and remain the exclusive property of SXN Labs or its partners.

Any reproduction, representation, modification, publication, transmission or exploitation, in whole or in part, without the prior written consent of SXN Labs, is strictly prohibited and constitutes infringement that may give rise to legal action.

The User retains the rights to the content they submit through the Services and grants SXN Labs a non-exclusive license to use such content strictly to the extent necessary to operate the Services.

8. Personal data

The processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

9. Liability

SXN Labs uses all reasonable means to ensure continuous, quality access to its Services. However, SXN Labs cannot be held liable for:

• Temporary interruptions, slowdowns or malfunctions of the Services.
• Direct or indirect damages resulting from the use, unavailability or inability to use the Services.
• Cases of force majeure as defined by French case law.
• Content, behavior or acts of third parties (users, partners, subprocessors).

The User is solely responsible for their use of the Services and for the resulting consequences.

10. Links to third-party services

The Services may contain links to third-party websites or services. SXN Labs has no control over these resources and disclaims any liability for their content, availability or data protection practices.

11. Suspension and termination

SXN Labs reserves the right to suspend or terminate, without notice or compensation, any User's access to the Services in the event of a breach of these Terms or where the User's behavior may harm the Services or third parties.

12. Changes

SXN Labs reserves the right to modify these Terms at any time. Changes take effect upon publication. It is the User's responsibility to review the current version regularly.

13. Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their interpretation or performance shall fall within the exclusive jurisdiction of the courts of the place of SXN Labs's registered office, subject to mandatory legal provisions to the contrary.
